By accessing or using CandidGO ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

Platform Role:
CandidGO is a hosting and delivery platform only. We do not generally review, verify, or endorse user-uploaded content before it is shared. Photographers are solely responsible for ensuring they have the legal rights to upload and commercialize their photos. We may investigate complaints and may remove content, disable links, or restrict account access where reasonably necessary to address alleged rights violations, legal risk, safety concerns, fraud, abuse, or breaches of these Terms.

Copyright Complaints:
CandidGO respects intellectual property rights and responds promptly to credible claims of copyright infringement. If you believe that content on CandidGO infringes your copyright, please send a written complaint to support@candidgo.com with the following information:
We will review copyright complaints as promptly as reasonably practicable. Where appropriate, we may remove or disable access to reported content while we investigate.
Repeat Abuse Policy:
Users who repeatedly upload infringing or otherwise unlawful content, or who repeatedly submit abusive or bad-faith complaints, may have content removed, accounts suspended, or access permanently terminated.
Privacy and Publicity Rights Violations:
If you believe a photo violates your privacy rights, publicity rights, or depicts you without your consent, please contact us at support@candidgo.com with:
We will review privacy and publicity complaints as promptly as reasonably practicable and may disable public access to the reported content while we investigate.
Subject Right to Removal:
Any identifiable individual depicted in a photo on CandidGO may request review of that photo by contacting support@candidgo.com. After identity verification, we may disable or remove the photo from public access where reasonably appropriate under our policies, legal obligations, or risk assessment. Removal from public access does not necessarily require deletion from backups, payment or accounting records, legal-retention systems, or copies already downloaded by recipients, and prior downloads may remain outside our control.
General Content Reports:
To report content that violates these Terms of Use (prohibited content, illegal activity, etc.), contact us at support@candidgo.com with the photo link and a description of the violation. We review all reports and remove content that violates our terms.
Paid Photos (Photo Unlock Payments):
When using the paid photo feature, payments are processed through Stripe Connect. Photographers must create a Stripe Connect account to receive payments. By using paid photo features, you agree to:
Photographers are responsible for their own tax reporting and compliance in their jurisdiction.
CandidGO does not store credit card information. All payment processing is handled securely by Stripe.
License to Photo Purchasers:
Payment for a photo grants you a personal use license only. The photographer retains all copyright. Subject to any later takedown, removal, legal restriction, or technical unavailability of the hosted link, you may view, download, and print the photo for personal use. Commercial use, redistribution, and resale are prohibited. CandidGO does not guarantee perpetual hosting, continued availability, or future re-download access to any purchased photo.
The App, including its design, code, and branding, is owned by CandidGO and protected by copyright and other intellectual property laws. You may not copy, modify, or reverse engineer any part of the App.

Your use of the App is also governed by our Privacy Policy. Please review it to understand how we collect and use your information.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any mandatory consumer rights under applicable law.
Subject to the paragraph above, the App is provided on an "as is" and "as available" basis. We do not guarantee that the App will be uninterrupted, error-free, secure, or always available, or that any content, link, or feature will remain available for any particular period of time. We may suspend, withdraw, or limit all or any part of the App for legal, security, maintenance, operational, or business reasons.
Subject to the paragraph above and to the maximum extent permitted by law, CandidGO is not liable for any indirect, incidental, special, consequential, or punitive losses, or for any loss of profit, revenue, business, goodwill, or opportunity arising from or in connection with your use of the App.
We are not responsible for whether user-uploaded photos are lawful, accurate, licensed, or properly authorized by the uploader. Any disputes regarding photo rights, consent, likeness, privacy, publicity, or legality are primarily between the photographer and the affected parties, although we may investigate and take action on reported content under these Terms.
You agree to indemnify, defend, and hold harmless CandidGO, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
This indemnification obligation will survive termination of your account and these Terms of Use.
We may update these Terms of Use from time to time for legal, regulatory, security, operational, or product reasons. If we make changes that are materially adverse to you, we will give reasonable advance notice where reasonably practicable, such as through the App or by email. Changes will apply from the stated effective date. They will not retroactively affect completed purchases, accrued rights, or existing dispute claims.
We may suspend or terminate your access to the App, remove content, or restrict particular features if we reasonably believe that you have breached these Terms, infringed another person's rights, created legal or regulatory risk, engaged in fraud, abuse, or unlawful activity, created a security risk, or caused issues with payment processing or third-party service requirements. We may also take temporary action while investigating suspected violations. You may delete your account at any time from Settings in the app.
Termination or suspension does not require us to restore removed content or expired links. However, prior licenses already granted to photo purchasers remain subject to these Terms, and we may retain information as reasonably necessary for legal compliance, legitimate recordkeeping, payment and accounting obligations, fraud prevention, complaint handling, and enforcement of these Terms, including the indemnification provisions.
These Terms of Use are governed by the laws of England and Wales. Nothing in these terms affects your statutory rights as a consumer in your country of residence.
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms constitute the entire agreement between you and CandidGO regarding the App.
